Judge rules in favor of convicted killer in custody case

When a child custody case is brought before a judge in California, the judge will use all the information he has gathered to make the final decision for where the best place is for the children to be raised. In a divorce, both parents are forced to abide by the ruling of the judge in terms of custody and visitation for either parent. There are unique situations where a custody case involves one parent and another guardian who is not a biological parent of the children.

The sister of a convicted killer is forced to make the choice between handing his children back over to their biological father or fighting a judge’s recent decision to return custody to the man, who was recently released from prison. Although the children don’t know their father well, the judge may have felt the bond between biological parent and child was most important in this case.

Woman and parents guilty in murder of custodial father

When a married couple in California chooses to divorce, custody of their child may be divided up in several different ways. Although many people may assume that the mother will be the best caretaker for the child, it may be important to look more closely at the situation to determine who should have physical and legal custody of the child. The situation must be assessed completely before a judge or mediator makes a decision regarding who is best able to care for the child.

After her ex-husband was granted custody of their daughter in their final divorce decree, a woman claims she plotted with her parents to kill him and his mother. Although the plan to kill the mother was uncovered by an undercover law enforcement official before being carried out, the woman’s ex-husband was killed in an altercation with her father.

Mother granted custody despite immigration status

Court cases for child custody don’t always involve two parents fighting for their child or children. At times, a grandparent in California may feel that they are better suited for raising the child, and may sue the parent(s) for custody of the child(ren). A judge will consider many factors in a child custody case before deciding whom the child will be happier with, and who will care for the child better.

After a lower court granted custody of a four-year-old girl to her paternal grandparents with the reasoning and that the mother was not in the country legally, an appeals court reversed the decision and gave custody of the little girl back to her mother. The grandparents felt they were best suited to raise the girl, possibly because she had been raised in their home until her mother broke up with her boyfriend, who is their son. The son was not involved in the custody case.

Californians not alone in custody battles: The stars do it too

Reality television star Bethenny Frankel and husband have been in the media for years; formerly for their marriage in “Bethenny Ever After,” and now for their divorce. The two have been reported on as disagreeing on the terms of their divorce among other things. A few weeks after his wife filed for divorce, Jason Hoppy reacted with his own version of their divorce, requesting many of the same things that Frankel did in her papers, especially the custody of their daughter.

Californians have likely heard of the couple, and for those who have gone through a divorce of your own, you likely understand the pain that can come from having to go through the legal system to work out where your children will live. When parents disagree, however, working with an attorney who knows and understand family law may be able to help the process go more smoothly and for the parties to come to an agreement sooner.
